How Does the Court Determine Child Support?

How do courts determine the amount of child support a parent is expected to pay? Today I’ll explain.


In the state of California, the court is mandated to follow a guideline formula. Typically, we use the DissoMaster program to determine the amount of child support using various factors such as:

  • The income of both parental parties

  • How much time each party spends with the children

  • Whether you have to pay health insurance

  • If you have to pay mandatory retirement

  • Whether you pay principle down on your mortgage

Expenses such as your car payment or your monthly rent are not considered when determining child support.

Once all the factors are entered into DissoMaster, the program produces a calculation for child support. This calculation will stand until there is another court order or until the child reaches the age of majority—this is typically 18 years old, but child support may last until the age of 19 if the child is still in high school.
