How long do you have to pay spousal support, or how long will you be able
to receive spousal support? In California,
we make that determination based on the length of the marriage. If the marriage lasted less than 10 years (called a short-term marriage),
you’ll pay or receive spousal support for half of the marriage’s
length. For example, if the marriage lasted eight years, spousal support
will last for four.
If you had a long-duration marriage (10 years or more), then the court
will deem what a reasonable amount of time for spousal support will be;
there is no set number in this case. However,
the court mandates that both parties must become self-supporting. Later, you can petition the court to modify your payments if either party’s
income changes, if either party retires, or something else has changed
since the court order.
